Richard provides online posture and movement analysis services based on videos, images, and information submitted by clients.
1. Eligibility
Services are available only to individuals aged 18 years or older. By purchasing or using the services, you confirm that you are at least 18 years of age.
2. Educational and Medical Disclaimer
All services are provided for educational purposes only and do not constitute medical advice, diagnosis, or treatment. No healthcare professional-client relationship is created. Richard does not diagnose medical conditions or provide medical treatment. The services do not replace advice from a qualified healthcare professional. Clients should seek medical clearance if unsure about participation.
3. Participation and Client Responsibility
Participation in any exercise or recommendation is voluntary and undertaken at your own risk. You are responsible for performing exercises safely and stopping immediately if you experience pain, dizziness, or discomfort. You are responsible for obtaining appropriate medical clearance where necessary. You confirm that all information provided, including PAR-Q responses and any health-related information, is accurate and complete.
4. Remote Assessment
All services are provided remotely and are based solely on the information, videos, and images submitted by you. Remote assessment has inherent limitations and is not equivalent to an in-person clinical evaluation.
5. Liability and Indemnity
To the fullest extent permitted by law, Richard shall not be liable for any injury, loss, damage, or claim arising from your use of the services or implementation of any recommendations. Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited under applicable law. You agree to indemnify Richard against claims arising from misuse of the services or failure to seek appropriate medical advice.
6. Refunds
Refunds are generally not offered once services have begun, except where required under UK consumer law or where the service cannot be delivered due to a technical or administrative error. Work is considered to have begun once submitted materials have been reviewed or analysis has commenced.
7. Data Protection
Richard is the Data Controller under the UK General Data Protection Regulation. Submitted videos, images, and any health-related information are processed solely for the purpose of providing the agreed services. Data is stored securely, retained for up to three years after the last service interaction for record-keeping and legal defence purposes, and may be processed internationally using appropriate safeguards in accordance with UK GDPR. You have rights under UK GDPR, including the right to access, correct, delete, restrict processing of, or withdraw consent relating to your personal data.
8. Video and Image Ownership
You retain ownership of all videos and images submitted. Richard will use submitted materials only for the purpose of providing the agreed services unless separate explicit permission is obtained for other uses.
9. Terms Updates
These Terms may be updated from time to time. The version in effect at the time of purchase will apply to that purchase. Continued use of the services following any update constitutes acceptance of the revised Terms.
10. Digital Delivery
Services are delivered digitally. You are responsible for ensuring you have appropriate internet access and compatible devices. Continuous or uninterrupted availability of services cannot be guaranteed.
11. No Results Guarantee
No specific physical, aesthetic, or performance outcomes are guaranteed. Results will vary between individuals and depend on factors including adherence, lifestyle, health status, and effort.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
